IP Enforcement & Litigation

Why enforce your IP rights?

Often, when a business expands into new markets or countries, it finds another entity using its trademarks, designs, or patents. In some cases, these businesses may have registered a copy of your trademark or design in that country before your market entry. When can you seek the cancellation of the conflicting right? When can you claim damages to recover losses caused by the infringement? When does this situation constitute unfair competition?

At NAL Group, we advise clients on enforcement strategies, risk assessments, and ways to strengthen their IP portfolios against potential infringements. our IP Enforcement and Litigation Services also cover:

Success Stories

COMBATING COUNTERFEIT IMPORTS

There are many tricks that are used to bring counterfeit products through border control, without being detected or penalized. One of these tricks is to bring in the counterfeit products without a brand or label then forge the brand in-land. Another trick is to state that the products are manufacturing components. NAL stopped thousands of counterfeit products from entering the market in Egypt by convincing the expedited matters court that the imported products are counterfeit. This saved the client years and thousands of dollars in enforcement actions trying to pursue the counterfeit products inland.

PHARMACEUTICAL PATENT ENFORCEMENT

A landmark case was won by NAL Group setting the first precedent in finding infringement in a  pharmaceutical patent infringement case in Egypt. The court not only found infringement but also awarded the patent owner hefty compensation and damages, and imposed fines on the infringing company. NAL Group team showed meticulous shrewdness in navigating a complex patent infringement case where the adversary sought invalidation of the patent, and submitted a plea for compulsory licensing. The case made it to the Special 301 statement, where for the first time it was stated that Egypt does enforce pharmaceutical patent rights.
