Success Stories

WIN WIN SOFTWARE LICENSE

A major payment services company decided to licenses a number of software systems from global industry leaders to create a system involving sellers and banks. It was important that intellectual property rights are not only licensed in from industry leaders, but that at the same time the company can act as sub-licensor, and license the software in its turn to banks and sellers. At the end of day the system will deal in trillions of transactions and dollars. This meant that drafting the software license agreement, negotiation and closing should be done while ensuring the rights are secured, and the liabilities are mitigated. Today not only the client enjoys a robust system and operation, but is confident that the intellectual property at the core of the system are secured by license and performance obligations. It derives revenue from use of the licensed software, as well as from licensing the software to others.

WALKING ON THIN ICE

A top celebrity was commissioned to produce videos promoting the services of an equally prominent company. This was like walking on thin ice. Though the celebrity wanted to license his performance (copyright) rights in the most limited way possible, the company needed a broader scope to recoup its investment and to ensure use of the videos and advertising campaign for long term and over all media. Being the Intellectual Property Counsel of the company the license was drafted allowing the company the right to also adapt the content for many other purposes. NAL also defended the company against other copyright owners who attempted to stop the advertising campaign and claim copyright ownership using the carefully drafted license agreement. This saved the company millions of pounds.
